We strongly urge you to read these Terms of Use before accessing our Website or Services. By accessing the Website or using Services, you agree to be legally bound by the Terms of Use and Privacy Policy as published and updated on the Website occasionally. It is your responsibility to understand and comply with these terms.

Please do not use our Services if you do not agree with our Terms of Use and Privacy Policy.

1. Definitions

1.1. In these Terms of Use, as well as in our Privacy Policy and all other terms, rules, or texts on the Website, the following terms shall have the following meanings.

  • “СryptoMap”, “we”, “us”, “our” – ANALOG AND DIGITAL SOLUTIONS LIMITED, a private limited company incorporated and existing under the laws of England & Wales (registration number 13177313), with its registered address at 228a First Floor, High Street, Bromley, Kent, United Kingdom, BR1 1PQ.
  • “Digital assets” – a digital representation of value that can be digitally traded or transferred and used for payment or investment purposes.
  • “Report” – information about the current state of laws and other regulations in a country or region.
  • “Services” – services provided at the Website on an “as is” and “as available” basis in the existing state of affairs, including any faults or problems.
  • “User”, “you” – anyone who enters, browses, or uses the СryptoMap Website.

2. Description of Services

2.1. CryptoMap offers users access to

  • a map (hereinafter – Map) depicting crypto regulations worldwide,
  • a questionnaire (hereinafter – Questionnaire) for business suitability, and
  • purchasable Reports detailing regulatory frameworks in specific countries.

2.2 The Website and Services provided are for informational purposes only and do not constitute legal or tax advice.

3. Map and Boundaries Disclaimer

3.1. The Map displayed on our Website shows countries coloured according to their regulatory stance on digital assets (green for positive regulation, yellow for restrictive regulation, red for prohibitive regulation, and grey for no regulation). The choice of colours is our own decision, and it is not intended to promote the interests of any country or group.

3.2. The boundaries, colours, denominations, and any other information presented on the Map do not imply any judgment on the legal status of any territory or any endorsement or acceptance of such boundaries by CryptoMap. This information is provided solely for users' convenience and should not be relied upon as authoritative.

3.3. We strive to update the Map conscientiously and diligently; however, we do not bear responsibility in case the information for certain countries has changed or does not correspond to the chosen colour indication at the time of your viewing the Website.

3.4. The geographic boundaries displayed on our website's globe image are based on data provided by a third-party service, GEOJSON. These boundaries are intended solely for informational purposes and do not reflect the political views, positions, or interests of the developers or creators of CryptoMap. We make no representations or warranties regarding the accuracy, completeness, or currentness of the boundaries. Consequently, CryptoMap shall not be liable for any legal, political, or other issues arising from the perception of these boundaries as incomplete, incorrect, insufficient, or offensive. Users are encouraged to consult appropriate sources for official and up-to-date boundary information.

4. Questionnaire 'Best Match for My Business'

The Questionnaire feature on our Website is designed to assist Users in identifying jurisdictions that may be suitable for their business based on the provided criteria. The results generated are based on general information and should not be considered exhaustive or definitive.

5. Reports

CryptoMap offers Reports that provide an overview of the regulatory framework for digital assets and digital assets related activities in various countries. These Reports are intended to be informational and do not constitute legal or tax advice. While the Reports are prepared with reasonable care and skill, CryptoMap does not guarantee the accuracy, completeness, or timeliness of the information in the reports.

6. Sale and Purchase of Reports

6.1. Reports can be purchased using debit/credit cards or via invoice. We accept debit/credit cards and provide an invoice option that includes crypto payment options.

6.2. Payments for Reports are processed through third-party service providers, including payment processors and digital wallet providers. The User acknowledges that these third-party service providers are responsible for processing any payments related to the purchase of Reports. The execution of the User’s transactions is solely the responsibility of these third-party providers. CryptoMap is not liable for any issues arising from the functionality of payments or transactions conducted via these third-party services. CryptoMap disclaims any responsibility for ensuring the successful completion of payments and transactions. In the event of any payment or transaction issues, the User agrees to address such matters directly with the third-party service providers. The User agrees to indemnify and hold CryptoMap harmless from any claims, damages, or losses arising out of or related to the use of third-party payment processing services. CryptoMap shall not be held liable for any failure or delay in processing payments due to circumstances beyond its reasonable control, including but not limited to acts of God, technical failures, strikes, or regulatory actions.

6.3. For payments via invoice, crypto payments can only be made in USDT, adhering to the ERC20 protocol on the Ethereum blockchain.

6.4. We do not accept crypto payments from residents of the following countries: Afghanistan, Belarus, Bosnia and Herzegovina, Burundi, Central African Republic, Democratic People’s Republic of Korea (North Korea), Democratic Republic of the Congo, Guinea, Guinea-Bissau, Haiti, Iran, Iraq, Lebanon, Libya, Mali, Myanmar, Nicaragua, Russia, Somalia, South Sudan, Sudan, Syria, Venezuela, Yemen, Zimbabwe.

6.5. Upon purchasing a report via debit/credit card, Users will receive a confirmation email detailing the order with links to the purchased reports. After the payment, Users will also be able to download the purchased Reports directly from the Website.

6.6. If you purchase a Report or Reports via invoice, you will be contacted via email.

  • If you choose to pay with cryptocurrency, we will send you an invoice indicating the purchased reports, the total sum, and the exchange rate USD/USDT applicable on the day of the inquiry. After making the payment, you must send us proof of the amount sent, including a screenshot from Etherscan, via email. Once we receive the USDT in our crypto wallet and the proof of the transaction, we will send you an email containing links to the purchased reports.
  • If you choose to pay with a bank transfer, we will send you an invoice indicating the purchased reports and the total sum in USD. After making the payment, you must send us proof of the amount sent, including the bank statement or bank receipt, via email. Once the payment is received in our bank account, we will send you an email containing links to the purchased reports.

6.7. All prices listed for Reports are in USD and are exclusive of taxes unless otherwise stated.

6.8. The pricing for the Reports is tiered based on the popularity and availability of information for each country:

$145 Tier: This price applies to reports covering countries with limited information or lower demand.

$225 Tier: This tier is for countries that are moderately popular or have a moderate amount of regulatory information available.

$265 Tier: This price is for reports on the most popular countries or those with extensive regulatory information.

6.9. Reports are delivered electronically to the User's email address indicated before the payment on the Website. Delivery is typically instant, but Users should allow up to 24 hours in case of technical issues.

6.10. Due to the digital nature of our products, all sales are final. Once the report has been delivered, no refunds or cancellations are permitted.

6.11. In the case of issues with the purchased Reports, Users should contact [email protected] for assistance.

6.12. Users are granted a non-exclusive, non-transferable right to use the Report strictly for their personal purposes. Users are expressly prohibited from distributing, reselling, or otherwise making the Report available to any third parties without obtaining prior written consent from CryptoMap. The User shall not modify, copy, reproduce, upload, post, transmit, or distribute in any way the contents of the Report without explicit permission from CryptoMap. CryptoMap reserves the right to take legal action against any User who breaches these terms, including but not limited to seeking injunctive relief and damages. The User agrees to indemnify and hold CryptoMap harmless from any claims, damages, or losses arising out of or related to the unauthorised use or distribution of the Report.

7. Chat Assistance

CryptoMap provides a chat feature (hereinafter – "Chat") integrated into the Website for user assistance. This service is operated by a third-party service provider. CryptoMap does not collect or store private or personal data through the Chat feature. Users are advised not to share personal or sensitive information through this service. For more details, please refer to our Privacy Policy. While CryptoMap strives to offer helpful and accurate information through the Chat service, CryptoMap is not responsible for the content provided by the third-party service provider. Users should independently verify any information received through the Chat and seek professional advice where necessary. CryptoMap disclaims any liability for actions taken based on information obtained through the Chat. The Chat is provided for general informational purposes only and does not constitute professional or legal advice. Users are responsible for not disclosing personal data in the Chat. CryptoMap cannot be held liable for any consequences resulting from the disclosure of personal information by the User.

8. Warranties and representations

The User represents, warrants and undertakes to us that:

8.1. The User is of legal age in their jurisdiction of residence and has the legal capacity to enter into these Terms if acting as an individual.

8.2. If entering into these Terms as a non-individual legal entity, the User has the full capacity and authority to do so. The User’s representative possesses the requisite power, authority, and capacity to accept these Terms on the User’s behalf. The User is validly incorporated, duly registered under the laws of their home jurisdiction, and has the requisite right, power, and authority to conduct their business.

8.3. The User does not and will not use virtual private network (VPN) software or any other privacy or anonymisation tools or techniques to circumvent or attempt to circumvent any restrictions applicable to the Services.

8.4. The User’s access to and use of the Services is not prohibited by the law applicable to the User or the Applicable Law of these Terms of Use.

8.5. The User’s access to and use of the Services does not contribute to or facilitate any activity deemed illegal under the law applicable to the User or the Applicable Law of these Terms of Use.

8.6. All information and documentation provided by the User in connection with their use of the Services is and will remain complete, accurate and truthful. The User shall promptly update CryptoMap on any material changes or inaccuracies.

8.7. The User shall perform their obligations under these Terms of Use in a manner that enables CryptoMap to comply with our requirements under Applicable Law.

8.8 The User shall promptly provide CryptoMap with any information requested that is reasonably necessary for CryptoMap to assess the User’s compliance with these Terms, comply with Applicable Law or the law applicable to the User, or undertake any reasonable and ongoing monitoring of risks related to the User’s use of the Services.

8.9. The User is not aware of and has not intentionally withheld any information or fact which may give rise to or result in the Services provided hereunder being in breach of Applicable Law or any other applicable law.

8.10. The User is not owned, controlled, or acting on behalf of an entity or individual related in any way to, or any persons within any country or jurisdiction, which are under economic sanctions or embargoes imposed by the United Nations, the United States, the United Kingdom, Switzerland, the European Union, or any of its Member States (“Sanctions”).

8.11. The User is not located, organised, or resident in a country or territory subject to Sanctions. The User further warrants that they will not transfer any funds, assets, or currencies, nor use the Services for the benefit of anyone subject to Sanctions or located, incorporated, or resident in a country or territory that is the subject of Sanctions.

8.12. THE USER UNDERSTANDS THE HIGH RISKS ASSOCIATED WITH DIGITAL ASSETS and will bear any such risks, including the risk of loss of part or all money or assets paid, transferred, or invested and the risk that cryptocurrencies and other digital assets are inherently volatile and may have little or no value or may rapidly or instantly lose significant part or all of their perceived value.

9. Indemnity

9.1. To the fullest extent permitted by law, User agrees to indemnify and hold harmless СryptoMap and its subsidiaries, affiliates, agents, and employees from and against any loss, expense, liability, damage, or claim (including all attorney’s fees) arising out of or related to

(i) User’s breach of these Terms of Use, the СryptoMap Privacy Policy or any other terms or rules published by СryptoMap on the Website,

(ii) User’s violation of the rights of third parties,

(iii) User’s misuse of the Services,

(iv) User’s violation of law, rules or regulations in connection with the use of the Services.

(v) User’s use of or conduct in connection with the Website, Services, Reports, or Chat.

(vi) Any claims or disputes arising from transactions or activities involving digital assets, including but not limited to cryptocurrencies, tokens, or any other blockchain-based assets;

(vii) Any loss, theft, or compromise of the User’s digital assets, private keys, or other credentials related to the use of the Services;

(viii) Any failure or malfunction of technology, software, or services provided by third parties in relation to the use of digital assets;

(ix) Any fluctuations in the value of digital assets and any resulting financial loss or gain experienced by the User;

(x) The User's involvement in any fraudulent or illegal activities related to digital assets.

10. Disclaimers

10.1. СryptoMap is not responsible for errors or omissions that may be in the content of the Website or Reports.

10.2. Under no circumstances will СryptoMap be liable for any special, direct, indirect, or incidental damages, or any damages whatsoever, whether as a result of contract, negligence, or other tort arising out of or in connection with the use of the Services, Reports, or other content of the СryptoMap Website. СryptoMap reserves the right to make additions, deletions, or changes to the content of the Services at any time without prior notice.

10.3. The User acknowledges that СryptoMap provides the Services on an “as is” and “as available” basis. We make no representations or warranties, express or implied, about the accuracy, completeness, reliability, suitability, or availability with respect to the information, products, services, or related graphics contained in Reports for any purpose. Any reliance the User places on such information is strictly at their own risk.

10.4. Under no circumstances will CryptoMap be liable to any party for any direct, indirect, special or other indirect damage resulting from any use of information or Reports on this website.

10.5. CryptoMap does not provide investment, financial, legal, or tax advice through the Website and the Reports, and nothing herein should be construed as such advice.

10.6. All content on cryptomap.io is owned by CryptoMap or its licensors and is protected under copyright law. Unauthorised reproduction, redistribution, or exploitation of any content on this website, in whole or in part, without prior written consent from CryptoMap, is strictly prohibited.

10.7. Unless expressly stated otherwise, all price information is indicative only. No representation or warranty, express or implied, is provided regarding the materials' accuracy, completeness, or reliability, nor are they a complete statement of the securities, markets, or developments referred to herein. Recipients should not regard the materials as a substitute for exercising their own judgment.

10.8. CryptoMap makes no warranty that the Services will be uninterrupted, timely, secure, or error-free. CryptoMap will not be liable for any interruptions or errors in the Services.

10.9. CryptoMap does not warrant the Website being free of viruses or other harmful components. The User is responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for data input and output accuracy and for maintaining a means external to the Website for reconstructing any lost data.

10.10. The User acknowledges that the use of digital assets, including cryptocurrencies, involves significant risks. CryptoMap makes no representations or warranties regarding the value, stability, or legality of digital assets. The User assumes all risks associated with the use and value fluctuation of digital assets.

10.11. CryptoMap will not be liable for any loss or damage arising from the User's use of or reliance on digital assets, including any loss due to technical failures, hacking, fraud, or regulatory changes.

10.12. The User acknowledges that digital assets are inherently volatile and may rapidly lose significant value. CryptoMap will not be liable for any financial losses incurred due to the volatility of digital assets.

11.    Limitation of liability

11.1. The User’s use of the Website and the Services is at the User’s sole risk. The Services are provided on an “as is” and “as available” basis, i.e. without any representations or warranties of any kind, express or implied.

11.2. To the fullest extent legally permissible, the CryptoMap does not make (and explicitly disclaim) any and all representations or warranties of any kind related to the Website and the Services, whether express, implied, or statutory, including (without limitation) the warranties of merchantability, non-infringement, and fitness for a particular purpose.

11.3. Neither CryptoMap nor anyone associated with CryptoMap makes any warranty or representation regarding the completeness, security, reliability, quality, accuracy, or availability of the Website or the Services.

11.4. To the fullest extent provided by law, in no event will CryptoMap or any of its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with the User’s use, or inability to use, the Website or the Services, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), misrepresentation, breach of contract, or otherwise, even if foreseeable.

11.5. This disclaimer of liability extends to any and all damages caused by any third party (including, without limitation, those caused by fraud, deceit, or manipulation), whether or not a participant, or any failure, exploit, or vulnerability of the Website or the Services.

11.6. The foregoing does not affect any liability that cannot be excluded or limited under Applicable Law.

12. Modification

CryptoMap reserves the right to change and modify these Terms of Use at any time and at its sole discretion. Unless stated otherwise in the relevant notice, all such modifications are effective immediately. Continued use of the Website or the Services following any changes or modifications to these Terms of Use constitutes unconditional acceptance of the revised Terms of Use and all terms incorporated by reference. It is your sole responsibility to review the Terms of Use as they are amended from time to time. If you do not agree to the amended Terms, you must stop using the Website or the Services immediately.

13.  Applicable law

These Terms of Use, all other documents incorporated in these Terms of Use by reference and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these documents or their subject matter shall be governed by and construed in accordance with, the law of England and Wales, including the entirety of its conflict of laws provisions.

14. Negotiations

In the event of a dispute arising out of or relating to these Terms of Use, the parties to such a dispute shall seek an amicable settlement of that dispute by negotiations.

15. Arbitration

15.1.  Should the User and CryptoMap fail to resolve the dispute by negotiations, any dispute, controversy, difference or claim arising out of or relating to this contract, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

15.2. This arbitration clause shall be the law of England and Wales.

15.3. The seat of arbitration shall be London, the United Kingdom.

15.4. The number of arbitrators shall be three. The arbitration proceedings shall be conducted in English language.

16. Miscellaneous

16.1 The division of these Terms of Use into sections and the headings of the various sections are for convenience of reference only and shall not affect the construction or interpretation of these Terms of Use.

16.2 Each provision of these Terms of Use is severable. If any provision is held to be or becomes illegal, invalid, or unenforceable in any respect under Applicable Law or any other law, mandatory provisions of which apply, then to the extent that it is illegal, invalid, or unenforceable and can be deleted without altering the essence of these Terms of Use, it shall be deemed to be deleted and shall not affect or impair the legality, validity, or enforceability of the other provisions of these Terms of Use. If the invalid, illegal, or unenforceable provision cannot be deleted without altering the essence of these Terms of Use, subject to Clause 12, CryptoMap or any competent Arbitral Tribunal may amend or order the amendment of these Terms of Use to remedy such invalidity, illegality, or unenforceability to the extent needed to achieve the intent of the original provision.

16.3 Without prejudice to any contrary provisions herein, these Terms of Use, together with the CryptoMap Privacy Policy and all other documents incorporated by reference, constitute the entire agreement between the User and CryptoMap and supersede any advertising or marketing material or any statements on the Website that are or may be construed contrary to these Terms of Use, as well as any previous negotiations, proposals, understandings, or agreements between the User and CryptoMap, express or implied.

16.4 These Terms of Use are drafted in the English language. If any translation of these Terms of Use is made, the terms of the English version will prevail over any inconsistent provision of any translation.
